The schedule set out above relates to and includes the following services
Taking and receiving your instructions and to our consideration of a small quantity of documents in support of your Claim, including invoices and a small amount of pre action correspondence
To undertaking company searches – where this is applicable
(Where legal proceedings are required) to drafting the Claim Form and Particulars of Claim and to submitting a request for the issue of the Claim
To applying to the Court for the entry of Judgment on your behalf
In the event that payment is not received, following the entry of Judgment, to discussing the various methods of the enforcement of that Judgment, which are accessible to you and to providing you with a further breakdown of the potential costs and Court disbursements, relating to each of those methods
To our receipt of payments and to paying those sums to you
Key Stages and Timescales
We will aim to consider your instructions and to prepare an initial demand for payment within 24 hours, however, it is likely that we will deal with your instructions on the same day as they are received. Our initial demand will seek payment within 7 days, however, where necessary, we will comply with any pre action protocols which may require us to give your opponent longer to respond than this initial period.
Where legal proceedings are required, we will arrange for the preparation and submission of a Claim Form (Part 7 proceedings) within 24 hours of being instructed to proceed. Where your instructions are received to enter Judgment in those proceedings, we will arrange to apply to the Court within 24 hours of your instructions.
Subject to the complexity of your Claim and where the Particulars of Claim fulfil the appropriate Court guidelines, legal proceedings are issued on the next business day after submission to Money Claim On Line (MCOL). Likewise, a request for Judgment, submitted to MCOL, is usually dealt with, and entered by the Court on the evening of the next business day, following submission.
In circumstances where we arrange for the preparation and service of a company Statutory Demand, pursuant to the Insolvency Act 1986, your opponent will have 21 days to respond to that Demand, following service. We have a nationwide network of process server agents who will arrange for service of a Statutory Demand within 48 hours of being instructed.
We will discuss with you any other key stages and timescales on an ad-hoc basis, dependant upon the complexity of your claim, the issues involved, the amount of the debt and any Court based delays which are known to us.
The basis of our charges
Our charges are usually calculated by reference to the time spent by our fee earners in respect of any work which they do on your behalf.
Our hourly rates are reviewed approximately every two years. As at October 2023, our hourly rates are as set out in the table below.
